Working with the Receipt of the Permesso

11 September 2026

Is it possible to work with the receipt of the permesso di soggiorno?

Yes, the law says that you can legally stay in Italy and work if you have the receipt of your permesso di soggiorno

So, is there a law that states this?

Yes, Article 5, comma 9-bis of the TUI (Testo Unico sull’Immigrazione).

What does it say, exactly?

This means that while waiting for the primo rilascio, rinnovo, or conversione of your permesso di soggiorno, even if the Questura does not meet the 90-day deadline, the foreigner is allowed to legally stay in Italy and work until notified otherwise by the authorities (who will also notify the employer). You can continue working as long as you have been issued the ricevuta showing that you applied for the release, renewal, or conversion.

My employer is still convinced it’s not possible.

Employers are not always fully informed, especially if they aren’t used to working with foreigners. If they continue to deny it even after seeing the law, unfortunately, there isn’t much else you can do.

So, I arrived with a work visa, but my permesso di soggiorno has not been issued yet. I only have the ricevuta and my visa has expired. Can I keep working?

Yes, the ricevuta legally allows you to stay and work until you receive your permesso di soggiorno.

Can I work with the ricevuta di ricerca lavoro?

Yes, you can.

Is there anything else the employer could argue to deny this?

Yes. If you did not submit your rinnovo on time (so 90 or 60 days before expiration), they could argue that your application is invalid. So you need to pay close attention to that.
