Is it possible to get married in Italy if I am a foreigner?

Yes, it is possible, if you are a foreigner and you have the residenza, or the domicilio in Italy, it will be necessary to do the “pubblicazioni di Matrimonio” at the comune of your city, instead if both spouses are foreigners and they don’t have the residenza and neither the domicilio, the pubblicazioni will not be needed, instead they will have to sign a statement, where they confirm there are no impediments of parentage, affinity, adoption or affiliation, etc. provided for the Civil Code

What are the pubblicazioni di Matrimonio?

It is a mandatory statement, that has the task to notify the other people who live in the city, to allow the enforcement of any impediments before the wedding. At least 10 days must pass from the pubblicazioni to the wedding date, and in these 10 days, 2 Sundays must be included

Everyone can oppose against the wedding?

No, only few people can do that:

  • Parents, and, only in their absence, the other ascendants and the collaterals within the third grade
  • The guardian or curatore, if one of the spouse is subject to protection or care
  • The spouse of the person who wants to do another wedding
  • In the cases referred to in art. 89 c.c. (prohibition of remarriage) the relatives of the previous husband and, if the marriage was declared null and void, the one with whom the marriage had been contracted and his relatives;
  • Public prosecutor

What do I need if I have the residenza or domicilio in Italy?

In this case you need to obtain the Nulla osta for the marriage “Nulla osta al matrimonio“

What is that?

The nulla osta al matrimonio is a document that states that by the law of your home country there is no impediments against your wedding

How can I obtain that?

  1. you are living in Italy you have to obtain it from the embassy/consulate of your country in Italy
  2. If you are currently abroad you can obtain it from the authorities of your country, but in this case, the Italian embassy/consulate must legalize it

Are there any exceptions?

Only if you have the status of refugee, in this case a “dichiarazione sostitutiva” will be enough declaration, to prove that there are no impediments Circolare Ministero dell’interno n.1 12/01/2022

My nulla osta has been denied, what can I do?

In this case, you can go to a Judge and through the court he has to check if there are no impediments to the wedding, and he has to obbligate the Ufficiale di stato Civile to do the pubblicazioni, even without the nulla osta

Is it possible for me to get married if I don’t have the permesso di soggiorno?

Yes, if the other person is Italian or if the other person is a foreigner with a regular permesso, but in any case the nulla osta is necessary

Do I need other documents?

It will be also necessary to show the ID card of the spouses

Someone else must be there?

It is necessary to have 2 witnesses and also in case one of the spouses or both don’t know the Italian language, it is also necessary to have an interpreter
